NORTH CANYON SWIM & TENNIS CLUB, INC.

Acknowledgement of Risk and Release of Liability

Important: Read this release. It affects your rights.

In consideration of the right to use the swimming pool, tennis courts, playground equipment or any surrounding premises of the North Canyon Swim & Tennis Club (collectively, the “Premises”), and by signing below, the undersigned, you, hereby:

1. Acknowledge that you, and any minor for whom you sign below, will follow the rules of North Canyon Swim & Tennis Club.
2. Acknowledge that use of the Premises presents significant risk, including the risk of injury and/or death.
3. Release North Canyon Swim & Tennis Club, its employees, independent contractors, officers, directors, and members (collectively the “Released Parties”), of and from all liability, claims, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage, illness or injury, including death, that may be sustained by you or the minor(s) identified below, or any of your property while in, on or upon the Premises. This release includes a release of any liability, claims, demands, actions and causes of action whatsoever against any or all of the Released Parties arising from any negligence on the part of any or all of them.
4. You further acknowledge that you are aware of the risks and hazards inherent upon the Premises, and in participating in activities on the Premises. Such risks and hazards include, but are not limited to, slipping on wet surfaces, striking the diving board or bottom of the pool, stepping on broken glass or other sharp objects, accidents caused by your or your minor’s rough play or the rough play of others, getting infections and/or communicable diseases from others also using the Premises, injuries from structural defects or conditions of the Premises and death by drowning or otherwise. You are aware of the present condition of the Premises and know that the Premises may become more hazardous and dangerous during the time that you or your minor(s) use the Premises. You are aware of your and your minor(s)’ ability and capacity to swim and otherwise use the Premises. You are aware that a lifeguard may not be present at all times and that no first aid care is available on the Premises. You agree not to let your children or the minor(s) listed below use the Premises without careful supervision of an adult, subject to the swimming competency standard listed below.
5. You agree that this Acknowledgment of Risk and Release of Liability is binding upon your distributes, heirs, next of kin, executors, guardians, administrators, successors and assigns.
6. You agree that by signing below you are acknowledging that you have read and understand this Acknowledgment of Risk and Release of Liability.
7. You represent and warrant that you are the parent or legal guardian of the minor child(ren) listed below and have authority to sign this document on behalf of such child(ren). You further agree to fully indemnify North Canyon Swim & Tennis Club for any claims, costs and/or legal fees arising from any alleged or actual breach of this warranty by you.
8. You agree that you and the minor(s) listed below will adhere to the following Swimming Competency Standard: All children under the age of 5 must be accompanied by an adult or responsible water safe child age 16 or older while on the Premises. Children under age 10 must be accompanied by an adult or responsible, water safe child age 16 or older, unless such child can swim the length of the pool (no diving), using good strokes unassisted as determined by the lifeguard on duty.
